Tageto FZCO (referred to in these Terms and Conditions as Tageto) operates the business of renting out launching ball machines through its mobile application (the Tageto App). The launching ball machines can only be rented by customers who have registered via the Tageto App.
These are the terms and conditions (the Terms) under which Tageto provides its services. They govern the use of the Tageto App and the rental contracts entered into via the Tageto App (the Tageto Services).
Please read these terms carefully. They explain how Tageto will provide its services to you, how to enter into or terminate a contract, what to do if there is a problem, and other important information.
Tageto FZCO is a company incorporated in Dubai and registered under number 12345678. Tageto's registered office is located at Business Bay, Dubai, UAE.

These Terms govern the use of the Tageto App and the rental contracts entered into using the Tageto App
These Terms may incorporate special terms depending on the city where the Tageto Services are provided, as each city may have specific local conditions (the Special Terms). The Special Terms will be included as an appendix to these Terms.
Tageto reserves the right to amend these Terms as required by law or due to technological changes. Tageto will inform you by email of any changes. These changes will be considered approved unless you object to them in writing within six weeks of being notified. You will be informed of your right to object at the same time you are notified of the changes.
To rent a Tageto launching ball machine, you must first register as a Tageto customer by creating a user account in the Tageto App. Each customer may only register once. Only registered customers may use the Tageto Services. Registration is not automatic.
When the registration process—during which you will be asked to accept these Terms and provide, in particular, your full name, email address, mobile phone number, and valid payment details—is completed successfully, you will have entered into a contract with Tageto for the use of the Tageto App (User Agreement). A copy of the User Agreement will be sent to you by email.
After registration, you may rent launching ball machines by concluding individual rental contracts in accordance with these Terms. Note that the User Agreement does not automatically grant you the right to enter into a rental contract for a machine.
Tageto reserves the right to refuse to enter into a User Agreement or any individual rental contract if it reasonably believes that the individual will not comply with these Terms.
You must be the named holder of the bank account or credit card whose details you provide to Tageto. You are responsible for keeping your personal data up to date, including your email address, mobile phone number, and payment details.
You may not permit third parties to use a Tageto launching ball machine that you have booked via your user account, and you may not provide your login details for use by other individuals. If there is reason to believe that someone else has accessed your login information, you must (a) change your password immediately and (b) notify Tageto of the situation.
To use the Tageto App, you must have a web-enabled mobile phone that meets the technical requirements of the Tageto App. You are responsible for ensuring that your mobile data service is active, and you bear any charges related to data transmission by your service provider.
You are prohibited from accessing, copying, or manipulating the Tageto App via information technology methods. If you are found to have violated this prohibition, Tageto is entitled to withdraw your access to the Tageto App immediately.
You must notify Tageto without delay of any loss or theft of the mobile phone associated with your user account, or of any circumstances that make it likely your user account could be misused by third parties. To prevent unauthorized use, Tageto will disable your account until the issue is resolved and will inform you via email.
The rental of launching ball machines is subject to availability. Machines are only available within a defined territory in a particular area (the Business Territory).
You may only rent machines that are designated as available in the Tageto App. Note that inaccurate GPS signals may occasionally cause deviations between the actual location of a machine and the location shown in the Tageto App.
A specific Tageto launching ball machine can be reserved free of charge for a maximum of ten minutes before starting a session.
By clicking “Start Session” in the Tageto App, you make a binding offer to rent the machine you have reserved. Tageto accepts this offer by releasing the machine for your use, creating a rental contract for that session.
The rental period begins when the individual rental agreement is made and ends when you finish your session in accordance with paragraph 7 or when the maximum rental period of 90 minutes expires.
You must notify Tageto without delay of any defects or damage to the machine that you become aware of before starting your session. You must not use a machine if any such defects or damage appear likely to impair its functionality.
All content, logos, and training methods are the property of Tageto and are protected by intellectual property laws.
When you want to end your session, you must properly park the launching ball machine in accordance with paragraph 8 and follow the procedure in the Tageto App to terminate the rental.
You must familiarize yourself with the boundaries of the Business Territory and the zones in which parking the machines is prohibited, as shown in the Tageto App. If you end your rental outside the Business Territory, you will be responsible for the costs of transporting the machine back to within the Business Territory.
You may terminate the rental via the Tageto App only if the machine is located within the applicable Business Territory and outside any restricted parking zones. Note that you cannot terminate a session without an active internet connection, so you may need to move the machine to a different location where an internet connection is available.
If you fail to terminate the rental via the Tageto App after parking the machine, the rental will automatically terminate after 90 minutes, unless the machine is subsequently moved or used again.
If you are unable to terminate the rental due to technical reasons, you must notify Tageto without delay to coordinate further procedures for ending the rental.
Your obligation to pay the rental fee ends only when the rental transaction is successfully terminated, unless it was impossible for you to terminate it due to reasons beyond your control.
Upon termination of the rental, the total rental period and the total rental fee will be displayed to you. You will also receive an invoice, which will be sent to the email address associated with your Tageto account.
Launching ball machines must be properly parked in Tageto station areas where allow battery recharge
You must not park the machines in a manner that endangers traffic safety or violates the rights or legal interests of third parties. The machine should be parked using its built-in safety mechanisms.
Specifically, the machines may not be parked:
At right angles to the road or sidewalk, near intersections, or in a way that obstructs road traffic ;
Machines must always be parked in accessible areas on private property, interior courtyards, parking garages, or customer parking bays unless these areas are specifically designated as Tageto parking spots.
You are required to pay the rental fee for using a launching ball machine. Prior to entering into a rental contract, the Tageto App will display the unlock fee for the machine as well as the per-session usage fee (inclusive of applicable taxes). The total rental fee is payable upon termination of the rental contract.
If, for reasons beyond your control, you were unable to use a machine despite it being shown as available in the Tageto App, you will not be charged for the rental.
You will be charged for your use of the machines either on a per-minute basis (fractions of minutes are charged as full minutes) or according to the terms of any prepaid package you may have purchased. Prepaid package purchases are subject to the relevant terms and conditions, available separately on the Tageto website.
Tageto works with various payment service providers. Payments are made using the method selected by you during registration. By entering into a rental contract, you confirm that you are authorized to make payments using the specified account. You are responsible for ensuring that your payment method can cover the rental fees. If a payment fails due to insufficient funds or other reasons for which you are responsible, Tageto may charge you a fee to cover the expenses incurred.
If you have any valid claims against Tageto, you may only set these off against Tageto’s claims against you to the extent that such claims are undisputed or have been legally determined.
Tageto reserves the right to assign its claims under its agreement with you to a third party, particularly for the purposes of debt collection. You will be informed in a timely manner about any such assignment. In the event of assignment, you will need to discharge your payment obligations directly to the third party.
However, Tageto will remain responsible for handling customer inquiries, complaints, and general support.
You are only permitted to rent and operate a Tageto launching ball machine if you:
You must be able to operate the launching ball machine without endangering others or violating any applicable safety regulations. You are required to have the necessary experience or basic skills in operating such machinery and must be familiar with its safe use.
You are expected to treat the launching ball machine with care and respect, complying with all applicable traffic and safety regulations. You must avoid causing harm to third parties or infringing on their rights.
You must report any accidents involving the launching ball machine to Tageto without undue delay. This includes any damage or malfunction that occurs during your rental period.
The launching ball machines are not equipped yet with GPS systems but Tageto to determine their exact location at any time. GPS functionality will be implemented soon to enhance service quality and security.
Tageto launching ball machines are covered by third-party liability insurance. The specific terms and conditions of the insurance coverage are available upon request.
Tageto is responsible for foreseeable loss and damage caused by Tageto. We maintain appropriate insurance coverage and safety measures to protect our users.
You are liable for any damages caused to the Tageto launching ball machine during your rental period. This includes damages resulting from improper use, negligence, or violation of these terms.
Tageto may temporarily disable your access to your user account if certain breaches occur, including but not limited to payment defaults, violations of these terms, or misuse of equipment.
The User Agreement is concluded for an indefinite period and may be terminated by either party with two weeks' notice prior to the end of any calendar month. Tageto reserves the right to terminate agreements immediately in cases of serious violations.
Tageto collects and processes personal data relating to you only to the extent necessary for performing its rights and obligations under the User Agreement. Please refer to our Privacy Policy for detailed information.
The User Agreement and any individual rental contracts are governed by the law of Dubai. The courts of Dubai shall have exclusive jurisdiction over any disputes arising from or in connection with these agreements.
You may not assign or transfer your rights or obligations under the User Agreement to a third party without Tageto's prior written consent. Any attempt to do so will be void.
